# Is ringless voicemail legal? RVM vs voicemail drop, and what the FCC decided

Ringless voicemail (RVM) places a prerecorded message straight into a cell phone's voicemail box without making the phone ring. Since November 2022 the FCC treats it as a call made with a prerecorded voice, which requires the recipient's consent. How it differs from a voicemail drop during a live call, what the TCPA, the courts and EU rules say, and how to automate voicemail without inviting a lawsuit.

Ringless voicemail (RVM) is a prerecorded message delivered directly into a cell phone’s voicemail box without making the phone ring. It is not the same thing as voicemail drop, which happens during a live call, after the recipient’s voicemail has picked up.

The difference matters, but less than RVM vendors once claimed. In November 2022, the FCC ruled that ringless voicemail to a wireless number is a call made with a prerecorded voice under the Telephone Consumer Protection Act (TCPA), which means consent first. This guide explains both mechanisms, walks through the legal position source by source in the US and in Europe, and lists the precautions to take if you automate voicemail in your outbound. It is not legal advice.

## What is ringless voicemail?

Ringless voicemail is an audio recording delivered to the voicemail platform of the recipient’s mobile carrier, addressed by the recipient’s phone number. The phone does not ring, or barely: the FCC’s 2022 ruling notes the device “may ring once” before delivery. The recipient sees a new voicemail notification and either listens or deletes it.

RVM was marketed for years as a way around robocall rules. The argument went like this: no ring, no call, no TCPA. A company called All About the Message, LLC asked the FCC to confirm that reading in 2017. The FCC refused.

Three traits define ringless voicemail:

- **No conversation is possible.** There is no call to answer.
- **It is sent in bulk.** Messages go out in batches, with no rep behind each one, the way a text campaign works.
- **The content is prerecorded.** Everyone gets the same message, sometimes in a synthetic voice.

## Ringless voicemail vs voicemail drop: what is the difference?

Voicemail drop starts with a normal call. The prospect’s phone rings. If they pick up, they talk to a rep. If voicemail answers, the dialer recognizes the greeting, waits for the beep, and plays a prerecorded message while the rep moves on to the next number. How the dialer tells a person from a voicemail is covered in our guide to [answering machine detection (AMD)](https://skipcall.io/en/blog/answering-machine-detection).

| | Ringless voicemail (RVM) | Voicemail drop |
| - | - | - |
| Does the phone ring? | No, or once at most | Yes, like any call |
| Can the recipient answer? | No | Yes, and they reach a rep |
| When is the message left? | Directly, with no call first | Only if voicemail answers |
| What triggers it? | A platform, in batches | The dialer, call by call |
| Content | Prerecorded | Prerecorded |
| US status on cell phones | Call with a prerecorded voice (FCC 22-85): consent required | Prerecorded message: treated the same way |
| Typical use | Mass campaign with no team | Outbound sequence run by reps |

The last row matters as much as the others. Voicemail drop keeps a real chance of conversation, which makes it a prospecting tool; RVM is a broadcast channel. But both rely on a recording. Legally, dropping a message during a call is not a “compliant version” of RVM.

## How does ringless voicemail work technically?

RVM platforms rely on access to mobile carriers’ voicemail servers. The message is addressed to the recipient’s mobile number, which identifies their mailbox, and deposited on the carrier’s platform. The FCC compared this to internet-to-phone text messaging and cited an expert who described it as essentially the same delivery model as mass texting.

Three practical consequences follow:

1. **It needs a mobile number.** RVM targets cell phones. It does not work on a main business line or a desk phone.
2. **Recipients cannot block it.** The FCC pointed out that consumers cannot block these messages and must spend time listening to or deleting them.
3. **It fills the mailbox.** Unwanted messages take up space and can stop wanted callers from leaving a message.

## Is ringless voicemail legal in the US?

The answer comes down to one document: **declaratory ruling FCC 22-85**, adopted November 14, 2022, released November 21, 2022 in CG Docket No. 02-278, and published in the Federal Register on December 14, 2022.

**What the FCC decided.** Ringless voicemail sent to a wireless phone is a “call” made using an artificial or prerecorded voice under the TCPA. It therefore requires the consumer’s consent. The FCC rejected every argument the petitioner made, denied its request for a retroactive waiver, and ruled even though the petitioner had asked to withdraw its petition.

**What the courts had already said.** The FCC was not breaking new ground. In March 2019, the Southern District of Florida held in _Schaevitz v. Braman Hyundai_ that a direct-to-voicemail message is a call under the TCPA, following a 2018 decision from the Western District of Michigan.

**The level of consent.** A call with a prerecorded voice to a cell phone requires prior express consent. When the message is telemarketing, FCC rules require **prior express written consent**. The revocation rules that took effect in 2026 apply too: our breakdown of the [TCPA rule changes of November 2026](https://skipcall.io/en/blog/tcpa-rule-changes-november-2026) covers opt-out keywords and deadlines.

**No B2B exemption on cell phones.** The TCPA rules on prerecorded calls to wireless numbers do not distinguish consumers from business people. A CFO’s mobile is protected like anyone’s. Four states (Florida, Oklahoma, Washington and Maryland) have mini-TCPAs with no B2B exemption on top of that. Our guide to [cold calling cell phones](https://skipcall.io/en/blog/cold-calling-cell-phones) goes through the practical consequences.

**The damages.** The TCPA gives recipients a private right of action: $500 per violation, up to $1,500 when the violation is willful or knowing (47 U.S.C. § 227(b)(3)). Run that against a 10,000-message campaign and you see why RVM is a favorite target of class actions.

**What about AI voices?** In a declaratory ruling of February 8, 2024, the FCC confirmed that AI-generated voices are “artificial” voices under the TCPA. An RVM read by a voice clone follows exactly the same rules.

The National Do Not Call Registry and your own internal do-not-call list apply on top of consent for telemarketing. Our overview of [whether cold calling is legal in the US](https://skipcall.io/en/blog/is-cold-calling-legal) sets out the baseline for live calls.

## What about Europe and the UK?

Europe has no RVM-specific rule, but it has a general one that fits. Article 13 of the **ePrivacy Directive (2002/58/EC)** requires prior consent for direct marketing through “automated calling and communication systems without human intervention.” A prerecorded message delivered in bulk, with no rep behind each send, most likely falls into that category. That is our reading, not a court ruling.

France is a good example of how strict the national versions can be. Article L. 34-5 of the Postal and Electronic Communications Code bans direct marketing by automated system to an individual who has not consented. The French data protection authority, the CNIL, allows B2B automated prospecting on legitimate interest only when the subject relates to the person’s job, with prior notice and an easy opt-out in every message. And since August 11, 2026, any telemarketing call to a French consumer requires prior consent. Our [cold calling laws by country](https://skipcall.io/en/blog/cold-calling-laws-by-country) guide compares 14 countries, including the UK, where the Privacy and Electronic Communications Regulations also require consent for automated marketing calls.

If your list mixes US and European contacts, the safest reading is simple: treat ringless voicemail as an automated call everywhere.

## Why RVM is also a sales problem

Say consent is on file and the legal side is clean. Ringless voicemail is still a weak choice for a B2B sales team, for four reasons.

**It removes the conversation.** Phone prospecting exists to talk to people. RVM strips out the one thing that makes the phone better than email: the chance that the prospect picks up and answers a question.

**It sounds like an ad.** An identical message sent to thousands of people sounds like one. A director who gets a voicemail with no missed call in their log knows they are part of a batch.

**It damages your number.** Annoyed recipients report numbers in call-blocking apps. Our guide to a [caller ID marked as spam](https://skipcall.io/en/blog/caller-id-marked-spam) explains how those reports drag down your future answer rates.

**It does not set up the callback.** A prospecting voicemail mostly makes the rep’s name familiar before the next dial. That works when the message follows a call that actually rang, from a number the prospect sees in their missed calls. Our data on whether to [leave a cold call voicemail](https://skipcall.io/en/blog/cold-call-voicemail) explains the logic.

## How to automate voicemail without inviting trouble

If you use voicemail in your sequences, a handful of rules reduce both the legal exposure and the irritation.

1. **Check consent before anything automated touches a US cell phone.** No prior express written consent, no prerecorded message. Leave a live voicemail or none.
2. **Go through a real call.** The phone rings, the prospect can answer, and a message is only left if voicemail picks up.
3. **Identify yourself.** Your name, your company and a callback number, which must be the number displayed.
4. **Offer a way out.** One sentence is enough: “If this is not relevant, reply STOP to a text from this number or tell me when you call back, and I won’t follow up.” Then make sure your tools honor it.
5. **Cap the frequency.** Drop a message on some attempts only, for example the first and last of a sequence. Our [parallel dialing best practices](https://skipcall.io/en/blog/parallel-dialing-best-practices) cover the cadence.
6. **Respect calling hours.** The TCPA window is 8 AM to 9 PM in the recipient’s local time; our [when-to-call tool](https://skipcall.io/en/tools/when-to-call) does the time-zone math.
7. **Record it well.** Under 30 seconds, a natural voice, no monotone reading. Our [B2B voicemail scripts](https://skipcall.io/en/blog/b2b-voicemail-scripts) give 12 templates to adapt.

Before a campaign, run your setup through the [cold calling compliance checker](https://skipcall.io/en/tools/cold-calling-compliance-checker). It does not replace a lawyer, but it asks the right questions.

## How does Skipcall handle voicemail?

Skipcall does not offer ringless voicemail. It offers [voicemail drop](https://skipcall.io/en/features/depot-message-vocal) during a normal call.

In a sequence, the **Voicemail if answering machine** setting lets you pick a prerecorded clip. The [power dialer](https://skipcall.io/en/power-dialer) or [parallel dialer](https://skipcall.io/en/parallel-dialer) calls the contact, the phone rings, and AI voicemail detection decides whether a person or a voicemail answered. A person is connected to the rep. A voicemail gets the message, dropped automatically while the rep moves on. The neighboring setting, **SMS if answering machine**, sends a text instead or as well, from your Skipcall number (see [SMS](https://skipcall.io/en/features/sms)).

Each drop counts as an automation: the Starter, Intermediate and Expert plans include 100 per license (see [pricing](https://skipcall.io/en/pricing)). The dropped message is logged on the contact record and synced to the connected CRM (HubSpot, Pipedrive, Salesforce or Attio).

Skipcall is the wrong tool if you want to push thousands of voicemails without calling anyone: it has neither the feature nor the intent. And voicemail drop does not exempt you from the rules. The message is still prerecorded, and checking that your audience and your consent records allow it is your job, especially on US cell phones.

## What to remember

Ringless voicemail and voicemail drop share their content, a recording, but not their sequence of events. The first avoids the call; the second follows from it.

In the US the question has been settled since FCC 22-85 on November 21, 2022: ringless voicemail to a cell phone is a call with a prerecorded voice. It needs prior express consent, written consent when it is marketing, at the risk of $500 to $1,500 per message, and B2B gets no pass on mobiles. In Europe, it is most likely an automated calling system that requires consent from individuals.

For a sales team, the best use of voicemail is the one that follows a real call: short, identified, infrequent, with a clear way out, and live rather than prerecorded on US cell phones without consent. It is less spectacular than a blast, but it is what sets up the next conversation.

FAQ

## Frequently asked questions

**What is ringless voicemail?**

Ringless voicemail (RVM), also called voicemail-to-voicemail or direct-to-voicemail, delivers a prerecorded audio message straight onto the voicemail platform of the recipient's mobile carrier. The phone does not ring, or rings at most once according to the FCC. The recipient only sees a new voicemail notification. RVM is sent in bulk by platforms, much like a text message campaign.

**Is ringless voicemail legal in the US?**

It is not banned, but it is regulated as a robocall. In declaratory ruling FCC 22-85, released November 21, 2022, the FCC held that ringless voicemail sent to a wireless number is a call made with an artificial or prerecorded voice under the TCPA, so it requires the recipient's prior express consent, and prior express written consent when the message is telemarketing. Each message sent without consent exposes the sender to $500 in statutory damages, up to $1,500 if the violation is willful or knowing.

**Is ringless voicemail legal for B2B?**

The federal TCPA rules on prerecorded calls to cell phones make no distinction between consumers and business people. A VP of Sales on a mobile number is protected like anyone else. Several states, including Florida, Oklahoma, Washington and Maryland, have their own laws without a B2B exemption. In practice, B2B ringless voicemail to cell phones needs the same written consent as B2C.

**What is the difference between ringless voicemail and voicemail drop?**

Ringless voicemail skips the call: the message lands in the voicemail box without the person ever having a chance to answer. Voicemail drop happens during a real call: the phone rings, the prospect can pick up and talk to a rep, and only if voicemail answers does the dialer play a prerecorded message while the rep moves to the next call.

**Does voicemail drop avoid the TCPA?**

No. The FCC's reasoning rests on the prerecorded content and the wireless number, not on the missing ring. An automatically dropped prerecorded message on a US cell phone is treated as a call with a prerecorded voice, which needs consent. A rep who leaves a live message after the beep is not using a prerecorded voice. The difference between RVM and voicemail drop is how the call unfolds, not a legal exemption.

**Are AI-generated voicemails treated differently?**

No. In a declaratory ruling of February 8, 2024, the FCC confirmed that voices generated by artificial intelligence are artificial voices under the TCPA. A ringless voicemail or a dropped message read by an AI voice follows the same consent rules as a recorded human voice.

**Is ringless voicemail legal in Europe?**

EU law does not name it, but the ePrivacy Directive (2002/58/EC, article 13) requires prior consent for automated calling systems without human intervention used for direct marketing to individuals. In France, article L. 34-5 of the Postal and Electronic Communications Code applies that rule, and the CNIL allows B2B automated prospecting only on legitimate interest when the subject relates to the person's job, with notice and an easy opt-out. Treat RVM as an automated call in Europe.

**Does Skipcall offer ringless voicemail?**

No. Skipcall offers voicemail drop during a normal call: the contact's phone rings, AI voicemail detection decides whether a person or a voicemail answered, and the prerecorded message is dropped only on voicemail. Each drop counts as an automation, with 100 per license on the Starter, Intermediate and Expert plans.
